A Berkeley County utility contractor was arrested by S.C. Department of Revenue agents on Friday on charges he failed to file tax returns.

Randall Lee Jones, 42, of Cross, owns Cape Fear Utilities LLC, a utility construction company. Jones was also charged with failure to account and pay over withholding tax for his employees.

The Department of Revenue alleges that Jones failed to file individual income tax returns between 2015 and 2017, during which time his business’s gross income totaled over $18 million.

The department also alleges that from 2015 to 2019, Jones prepared federal W-2 forms for his employees that included S.C. taxable wages of at least $4.68 million and withholding of at least $238,876, which the department says he failed to remit.

Jones is charged with three counts of failure to file individual income tax returns and four counts of failure to account and pay over withholding tax.

If convicted, Jones could be sentenced to $10,000 and five years in prison per withholding charge, as well as $10,000 and one year in prison for each charge of failure to file income taxes.
